Enrolment and Customer Terms
Effective 1 October 2026

These Enrolment and Customer Terms set out the conditions that apply to enrolments, payments, attendance, participation and the use of Swim Mechanix services and facilities. They apply at all Swim Mechanix locations and at third-party facilities from which Swim Mechanix delivers programs.

By accepting these Terms, enrolling a swimmer or continuing to participate after being notified of an update, you agree that these Terms form part of your agreement with Swim Mechanix and agree to comply with them.

Separate payment, privacy, child-safety, photography, refund and cancellation, and participation-risk documents may also apply.

1. Enrolments
-
Enrolment requests are subject to class availability, appropriate swimmer level, staffing, facility capacity and approval by Swim Mechanix.
-
An enrolment is confirmed when Swim Mechanix approves it and the required payment or authorised payment arrangement is in place.
-
Swim Mechanix may move a swimmer to another suitable class following assessment, consultation or progression, or where reasonably required because of enrolment levels, class viability, staffing, timetable changes or other operational requirements.
-
Where practicable, Swim Mechanix will consult with the customer and provide reasonable notice before moving a swimmer.
-
A place is not guaranteed by submitting a request, joining a waitlist or attending a trial.
-
Customers must keep their contact, emergency, medical and payment information current in the Swim Mechanix App or Customer Portal.
2. Fees and payment
Fees are payable in advance under the billing option offered and selected for the enrolment.

Depending on the applicable program, customers may select:
-
automatic term billing; or
-
automatic monthly billing.
Both arrangements use the customer’s nominated recurring payment method and are subject to the Swim Mechanix Automatic Payment Agreement Terms.
a) Automatic term billing
-
Customers using automatic term billing will be charged the full fees for the upcoming term in advance.
-
Term fees are calculated according to the number of regular lessons scheduled during that term.
-
Public holidays, scheduled breaks and planned closure dates where no regular lesson is held are excluded.
-
The upcoming charge and scheduled debit date will be communicated before payment is processed.
-
The scheduled debit date may vary between terms according to the applicable term calendar.
-
Available account credits will be applied automatically before the remaining balance is charged.
-
If the term balance is paid manually before the scheduled debit is processed, only any remaining amount properly due will be charged.
-
Customers must ensure sufficient cleared funds or available credit are present before the scheduled debit date.
-
Automatic term billing will continue for each subsequent term while the enrolment remains active, unless the billing arrangement is changed or the enrolment is cancelled in accordance with these Terms.
b) Automatic monthly billing
-
Charges are raised on or around the 15th of each month and processed on or around the 28th for lessons scheduled in the following calendar month.
-
Monthly charges are calculated according to the number of regular lessons scheduled during the applicable month.
-
Public holidays, scheduled program breaks and other published dates on which regular lessons are not held are excluded.
-
Processing dates may vary because of weekends, public holidays, banking days or payment-provider requirements.
-
Available account credits will be applied automatically before the remaining balance is charged.
-
Customers must ensure sufficient cleared funds or available credit are present before the scheduled debit date.
c) Payment fees and outstanding balances
-
From 1 October 2026, eligible payment-card transactions do not attract a card surcharge.
-
Bank-account transaction fees and failed-payment fees may apply as set out in the Automatic Payment Agreement Terms.
-
If a payment fails, the outstanding amount and any applicable failed-payment fee remain payable.
-
An outstanding balance may be included for processing in the next scheduled billing cycle unless it has already been paid.
-
Customers may pay an outstanding balance through the Swim Mechanix App or Customer Portal.
-
Swim Mechanix may prevent further bookings or participation while an account remains overdue.
-
Customers will ordinarily be contacted before an enrolment is cancelled because of persistent non-payment.
3. Continuing enrolment
-
Regular lesson enrolments continue automatically from one term or billing period to the next unless the customer cancels the enrolment in accordance with these Terms.
-
Customers do not need to re-enrol for each new term.
-
Fees will continue to be charged under the customer’s selected billing arrangement while the enrolment remains active.
-
Continuing enrolment is subject to the customer’s account remaining current, the program continuing and the class remaining suitable for the swimmer.
-
Class times, instructors, program structures and locations may change between terms or billing periods.
-
Swim Mechanix will provide reasonable notice of changes where practicable and may offer another suitable class where necessary.
-
Instructors may be substituted temporarily or permanently. A change of instructor does not entitle the customer to a refund, account credit or Make-up Token, provided a suitable lesson continues to be delivered.
-
Holiday Programs, trials and other programs identified as fixed-term or one-off bookings do not continue automatically unless Swim Mechanix advises otherwise.
-
Trial lessons, promotional offers and introductory bookings are subject to any additional conditions stated at the time of booking.
4. Cancelling or changing an enrolment
To cancel an enrolment and prevent the next scheduled payment, valid cancellation notice must be received by Swim Mechanix at least 48 hours before the next scheduled debit date.
Cancellation notice must be submitted through one of the following channels:
-
a Student Enrolment Drop Request through the swimmer’s enrolment in the Swim Mechanix App or Customer Portal;
-
an email to hello@swimmechanix.com.au; or
-
the Contact Us form on the Swim Mechanix website.
A telephone call, voicemail, SMS, social-media message, non-attendance or removal of a payment method does not constitute formal notice of enrolment cancellation.
-
Cancellation takes effect when the request is received by Swim Mechanix, not when the swimmer last attends.
-
For monthly billing, the next scheduled debit date means the debit date for the next monthly billing period.
-
For automatic term billing, the next scheduled debit date means the debit date for the upcoming term shown on the customer’s account or upcoming charge notice.
-
Where valid cancellation notice is received at least 48 hours before the scheduled debit date, the upcoming enrolment charge will not be processed and the enrolment will end at the conclusion of the period already paid for.
-
Where cancellation notice is received less than 48 hours before the scheduled debit date, the upcoming charge may still be processed and the enrolment will remain active for the period covered by that payment.
-
Fees already charged or otherwise due remain payable and are not ordinarily refundable.
-
Stopping, disabling, removing or disputing an automatic payment does not cancel the enrolment.
-
Requests to change a swimmer’s class, day, time, instructor or location are subject to suitability and availability.
-
A class-change request does not constitute notice of cancellation.
-
Enrolments cannot be placed on hold unless Swim Mechanix agrees in writing because of exceptional circumstances.
-
Swim Mechanix may cancel an enrolment because of persistent non-payment, prolonged unexplained non-attendance, unsafe or disruptive conduct, or a serious or repeated breach of these policies.
-
Where appropriate, Swim Mechanix will provide reasonable notice and an opportunity to address the issue.
5. Absences and Make-up Tokens
Make-up Tokens are a flexible benefit offered for eligible absences. They do not guarantee that a replacement lesson will be available.
-
An absence must be reported before the swimmer’s scheduled class commences.
-
Absences may be submitted through the Swim Mechanix App or Customer Portal.
-
Absences may also be reported by telephone to Swim Mechanix during operating hours. The telephone notification must be received and recorded before the class commences.
-
Absences reported by email, SMS, in person or after the class has commenced do not qualify for a Make-up Token.
-
Make-up Tokens will not be issued retrospectively for an absence that was not reported correctly and on time.
-
An eligible token is issued after the missed class has occurred. Tokens are not issued in advance.
-
There is no limit to the number of Make-up Tokens that may be issued for eligible absences.
-
Each token expires 90 days after its date of issue.
-
Expired tokens will not ordinarily be reinstated or extended.
-
Make-up classes may be booked up to 14 days in advance and are subject to availability.
-
Availability with the swimmer’s regular instructor, day, time, class or location is not guaranteed.
-
Tokens may be used across Swim Mechanix locations where a suitable class and place are available.
-
The swimmer must have a current active enrolment or a confirmed and paid future enrolment to use a token.
-
Families are responsible for selecting a class appropriate for the swimmer’s current level.
-
If a swimmer does not attend a booked make-up class, the token is forfeited and no replacement token will be issued.
-
Tokens have no cash value and cannot be refunded, transferred to another family or applied as an account credit against regular lesson fees.
-
Tokens cannot ordinarily be used for Holiday Programs unless Swim Mechanix expressly permits this as part of a separate promotion.
-
Swim Mechanix may change or cancel a make-up booking where reasonably necessary, including where the place is required for a permanent enrolment or for operational or safety reasons.
-
If Swim Mechanix cancels a make-up booking, the token will be returned to the swimmer’s account and its expiry date may be extended where reasonably necessary to provide another opportunity to use it.
The full conditions are contained in the Swim Mechanix Absence and Make-up Token Policy.
6. Illness and medical absences
-
Swimmers and accompanying adults must not attend when unwell, contagious or subject to a public-health exclusion requirement.
-
Do not attend when experiencing vomiting, diarrhoea, fever or other symptoms that may create a health risk in an aquatic environment.
-
A person who has experienced gastroenteritis, vomiting or diarrhoea should not return until they have been free from symptoms for at least 72 hours, or for any longer period recommended by a health professional or current public-health guidance.
-
For other infectious conditions, customers should follow current medical and public-health advice about when it is safe to return.
-
Swim Mechanix may refuse participation or ask a person to leave where staff reasonably believe their attendance presents a health or safety risk.
-
Ordinary short-term illness is managed through the Absence and Make-up Token rules.
-
For a serious medical condition or extended medically required absence, a customer may request special consideration in writing.
-
Supporting medical information may be required. Any credit, pause or adjustment will be assessed case by case and is not automatic.
7. Late arrival and leaving early
-
Customers should arrive in time for the scheduled class.
-
A swimmer who arrives more than 10 minutes late may be unable to participate because of safety, warm-up and class-continuity requirements.
-
Late arrival, early departure or partial attendance does not qualify for a Make-up Token, refund or account credit.
8. Cancellations or changes by Swim Mechanix
-
Swim Mechanix may cancel, relocate or modify a lesson because of instructor unavailability, facility issues, unsafe conditions, emergency directions or other operational circumstances.
-
Customers will be notified as soon as reasonably practicable through available contact channels.
-
Swim Mechanix may provide a suitable replacement lesson where reasonably practicable.
-
Where Swim Mechanix cancels a paid lesson and does not provide a suitable replacement, an account credit will ordinarily be applied.
-
Available account credits will ordinarily be applied automatically against the next eligible charge.
-
Where the customer has no remaining or future charges, they may request a refund of an eligible credit arising directly from a lesson cancelled by Swim Mechanix.
-
A temporary or permanent change of instructor does not entitle the customer to a refund, account credit or Make-up Token, provided a suitable lesson continues to be delivered.
-
Swim Mechanix is not responsible for indirect costs associated with a cancellation, including travel, parking, accommodation or lost time, except where liability cannot lawfully be excluded.
9. Refunds and account credits
-
Refunds and account credits are not provided for a customer absence, missed lesson, late arrival, early departure or change of mind, except where required by law or expressly provided under these policies.
-
Unused, forfeited or expired Make-up Tokens are not refundable and cannot be converted into account credit.
-
Eligible account credits may arise from a lesson cancelled by Swim Mechanix, an approved extended medical absence, an authorised billing adjustment or another circumstance expressly approved by Swim Mechanix.
-
Available account credits will ordinarily be applied automatically against future eligible charges.
-
Promotional credits, Make-up Tokens and other non-cash benefits cannot be redeemed for cash.
-
Requests arising from exceptional circumstances must be made in writing and will be considered case by case.
-
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
Additional conditions are contained in the Swim Mechanix Refunds and Cancellations Policy.
10. Supervision and facility use
-
A responsible adult must supervise every child under 12 before, during and after lessons, including in waiting areas and changerooms.
-
The responsible adult must remain at the facility unless Swim Mechanix has expressly confirmed another arrangement.
-
Parents and carers remain responsible for siblings and other children in their care who are not participating in a class.
-
Participants and visitors must follow staff directions, safety signs and facility rules.
-
The pool and equipment may only be used as directed.
-
The pool is not available for recreational use before or after lessons unless Swim Mechanix expressly permits it.
-
At third-party venues, customers must also comply with the facility operator’s rules.
-
Customers must not use school, playground or other equipment outside the areas made available to Swim Mechanix.

Swim caps are required unless an exemption is agreed because of a medical, disability or sensory requirement.

Customers must stop photographing or recording when directed by Swim Mechanix staff.
-
A person who does not comply may be directed to remove the device, stop recording or leave the facility.
-
Any child-safety concern may be raised with a Swim School Coordinator, another Swim Mechanix staff member or by emailing hello@swimmechanix.com.au.

Child-safety concerns will be taken seriously and handled in accordance with the Swim Mechanix Child Safety and Wellbeing Policy.
-
If a child is in immediate danger, contact emergency services on 000.
